Terms & Conditions

PURCHASE PRICE

The purchase price of a single raffle ticket is $25.00 each; or $100.00 if 5 raffle tickets are purchased at one time. A "purchase" shall not occur and be binding on Butler Creek Trail Association until funds received for the same have cleared the bank. Credit cards are NOT accepted. Tickets may be purchased online at www.butlercreektrail.com. Ticket purchases are not tax deductible. Each raffle ticket purchased shall constitute an "entry" into the raffle, and the person to whom the raffle ticket is registered shall be the "Entrant." The winning Entrant shall be the "winner" of the prize. Payment to or delivery of any prize will be made to the Entrant. The winner must supply his/her social security number before the prize is tendered.

QUANTITY OF TICKETS

There is no maximum number of tickets offered for sale, but we anticipate selling at least 500 tickets.

ELIGIBILITY

Purchasers of raffle tickets must be legal residents of the United States and 18 years of age or older on, or before, September 16, 2003. The Entrant must supply his/her social security number to receive winning prize. Tickets will be electronically recorded for Internet purchasers upon order. Raffle ticket numbers will be automatically assigned in order of date purchased. Raffle tickets are non-transferable and non-refundable; all tickets sales are final.

INTERNET PURCHASES

This raffle will be posted on the Internet at www.butlercreektrail.com/raffle. It is the purchaser's responsibility to provide a valid email and US Postal mailing address and contact information in order to successfully receive the ticket confirmation and to remove any system blocks that would prevent the successful delivery of the email confirmation.

TAXES AND IRS RULES

Winner is responsible for any and all federal, state and local income or excise taxes, fees, assessments and like charges associated with the prizes. Winner will be responsible for any or all delivery fees and/or are responsible for retrieval of their prize. The value of your winnings is considered taxable income. Please consult your financial advisor to discuss any impact on your personal taxable income. The IRS has taken the position that amounts paid for chances to participate in lotteries, raffles, or similar programs are not gifts and therefore, the price of entry does not qualify as a deductible charitable contribution.

DRAWING

The raffle will take place for the Sea Carpet and Yeti gear on August 8, 2021 at a 5 pm. The remaining items will be drawn for in September 2021 at a TBD time and location. Tickets will be available for purchase until the time of the drawing. The winner, if not present, will be notified within 7 business days. It is the responsibility of the purchaser to provide a valid, deliverable mailing address, phone and email address for notification.

PRIZES

One winner will be chosen for each of the items to be raffled, as described on butlercreektrail.com. Total retail value of all prizes is estimated at $5,000. All federal, state and local income, sales and/or excise taxes, fees, assessments and like charges associated with the prize, are the responsibility of the holder of the winning ticket. Winner must complete a W-9 form before receiving prize.

NOTIFICATION OF WINNERS

Winner need not be present to win. Winner will be notified by phone and/or in writing via Registered Mail of requisite procedure to claim prize. Winner's name will be posted at www.butlercreektrail.com/raffle within 5 calendar days of the drawing. Winning entrant has up to thirty (30) calendar days of draw date to finalize the process (including payment of taxes, withholding, etc). If selected winning entrant is unable to be contacted or located after a period of one (1) month from the draw date, or if the entrant refuses to take possession of the prize awarded the prize will be donated to Butler Creek Trail Association. Three (3) attempts will be made to contact the winning entrant via Registered Mail at the address provided by the entry purchaser and via email and phone as provided.

VOID WHERE PROHIBITED BY LAW

This raffle is conducted in accordance with gaming laws enacted and enforced by the State of Montana and void in areas prohibited or restricted by law. Raffle promoters and/or Butler Creek Trail Association are not responsible for lost or stolen entries. Raffle entries will be disqualified, at the sole discretion of Butler Creek Trail Association, if attempts are made to disrupt the Raffle or circumvent the terms and conditions of these Official Rules. If the above occurs, Butler Creek Trail Association reserves the right to remedy any such action, disruptions, or circumvention in a manner, determined solely by Butler Creek Trail Association Board of Directors that is fair and equitable to Raffle participants. Butler Creek Trail Association, its members, contractors, accountants and legal advisors are not responsible for and shall not be liable for: (i) late, lost, delayed, damaged, misdirected, incomplete, illegible, or unintelligible entries; (ii) failed, returned, or misdirected notifications based on inaccurate information provided by the winner; (iii) telephone, electronic, hardware or software program, network, Internet, or computer malfunctions, failures, or difficulties resulting from participation in this Raffle of otherwise; (iv) errors in transmission; (v) any condition caused by events beyond the control of Butler Creek Trail Association that may cause the Raffle to be disrupted or corrupted (vi) any injuries, losses, or damaged of any kind caused by a prize or resulting from acceptance, possession, or use of a prize, or from participation in the Raffle; or (vii) any printing of typographical errors in any materials associated with the Raffle.

WAIVER AND LIMITATIONS OF LIABILITY

Entrants release Butler Creek Trail Association, and its respective board, donors, volunteers, employees and representative agents from any and all liability with respect to participation in the promotion and possession of the prize. Any liability of Butler Creek Trail Association shall be limited to the ticket price paid. In the case of a dispute, Butler Creek Trail Association’s board decision shall be final. Entrant agrees to allow Butler Creek Trail Association to use his/her name, and image without any compensation for any promotional activity related to this or any future raffle. Any and all addresses and contact information of the purchaser will not be released to the public.
